It isn't a question of what they believe, it is question of what they think they can prove beyond a reasonable doubt. If the husband was into bondage games proving deliberate murder (absent say a lover and some big recent increases in life insurance) beyond a reasonable doubt would be difficult. People do stupid dangerous things which cause death or injury all the time without intending harm. Consider for example all the guys who have accidently hung themselves.

I remember a story about a Mississippi Sheriff's Deputy, who in his eagerness to demonstrate how the black man hanging from a tree, with his hands tied behind his back with a web belt, could have been suicide and not a lynching met with an unfortunate accident. In the process of his elaborate demonstration, including a Houdini like ability to ties his own hands in front and step through, he slipped, and proceeded to hang himself. The startled onlookers were unable to revive him.

I was a bit surprised to read some stats, a couple of years ago, on unsolved murders. I can't remember the figures, but certainly the rate of unsolved murders was quite a bit higher than I had realized. Perhaps as high as 25 percent. Some people do get away with murder.
